What Does The Vocational Evaluation Involve?
A vocational evaluation is a process used to determine an individual’s current and future employability and earning potential. This evaluation is often used in legal proceedings to provide evidence of an individual’s work abilities and pre- and post-injury earning capacity. The evaluation may also include a plan for how the individual can re-enter the job market if possible. The evaluation consists of five steps, which include:
ONE: Reviewing Pertinent Medical, Vocational and Employment Records
Reviewing pertinent medical, vocational, and employment records is an important part of a vocational evaluation. This process involves reviewing all relevant documentation that provides information about the individual’s work and medical history, including medical records, job performance evaluations, and any previous vocational assessments. This information is used to help the vocational expert understand the individual’s work abilities and challenges, as well as any limitations or restrictions that may affect their employability. By reviewing these records, the expert can get a comprehensive understanding of the individual’s work history and identify any patterns or trends that may impact their future career prospects.
TWO: Interviewing The Plaintiff or Claimant
The first step is an interview and review of medical records. A vocational expert asks the individual questions about their work and life experiences, medical history, activities of daily living (ADLs), age, time away from the workforce, education, career goals, motivation, and current personal and family situation. This information is used to assess the individual’s employability.
THREE: Vocational Testing
The second step of the evaluation involves administering standardized vocational tests to assess the individual’s employability. There are many different tests that may be used, depending on the individual’s specific circumstances. These tests are used to create a profile of the individual’s work-related traits, including academic achievement, ability and aptitude, interests and personality, work values, skills, and dexterity and coordination.
FOUR: Labor Market Research
The fourth step of the evaluation involves conducting labor market research to gather information about earnings, qualifications, and training requirements for specific job titles in the area where the individual may be able to work. Resources typically used for Labor Market Research include the U.S. Bureau of Labor Statistics (BLS) and, in California, the Emplyoment Development Department.
FIVE: Vocational Expert Analysis
The final step of the evaluation is the vocational expert’s analysis of all the information gathered during the evaluation process, including observations, medical and psychological reports, labor market research, test data, and diagnostic information.
The vocational expert will use this information to formulate an opinion on the individual’s pre- and post-injury employability and earning capacity and provide recommendations for next steps based on the individual’s immediate and long-term job and career goals. A comprehensive vocational report outlining these recommendations will be issued.
